1. Who we are

NOSH DEV (Pty) Ltd, registration number 2026/715327/07, a private company registered in the Republic of South Africa, registered office 7594 Moleleki Ext 2, Katlehong, Germiston, Gauteng, 1434. Referred to as "we" or "us". You are the "client".

2. What we provide

We build, publish and host software products — mobile apps, WhatsApp assistants, business phone lines and related systems — to your requirements, at the prices set out on this page. The scope of each project is agreed in writing before work begins.

3. Payment

• A deposit is payable before work starts. The balance is payable on delivery.
• The monthly fee starts the month after delivery and continues until you cancel.
• All prices are in South African Rand. NOSH DEV is not currently registered for VAT, so no VAT is charged.
• If a monthly payment fails we will contact you. If it stays unpaid for 14 days, hosting may be suspended until it is settled.

4. Who owns what you get

You own your product. Once the once-off fee is paid in full, the application we built for you — including its source code and content — belongs to you. You may take it elsewhere at any time and we will help with the handover.

We keep ownership of our own underlying tools, templates and components, which we reuse across projects. That does not affect your ownership of your product.

5. What you're responsible for

• Giving us accurate information, content and branding.
• Holding the rights to any content, logos or trademarks you give us.
• Your own Apple and Google developer accounts, and their fees.
• Using your product lawfully.

6. Acceptable use

You may not use our services to build or run anything that:

• infringes anyone's intellectual property, including copying another company's branding;
• is fraudulent, misleading, or used to deceive people;
• is illegal under South African law, or helps others break the law;
• distributes malware, or collects personal information without proper consent;
• harasses, threatens or targets individuals;
• sends unsolicited bulk messages over WhatsApp, SMS or voice.

We may suspend or end services immediately, without refund, if these terms are breached. We will tell you why.

7. Timelines

We give honest estimates and work to them, but delivery dates are estimates, not guarantees. Delays caused by waiting on information from you, or by Apple's, Google's or Meta's review processes, are outside our control.

8. Liability

We are responsible for delivering the work we agreed. We are not liable for indirect or consequential losses, including lost profits or lost business. Our total liability is limited to the fees you paid us in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited under South African law, including under the Consumer Protection Act.

9. Cancellation

You may cancel the monthly service at any time by contacting us. See the Refund Policy for what happens to money already paid. On cancellation we provide your source code and data on request.

10. Governing law

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.

The once-off build fee

This fee covers work we actually perform. Once your product has been built and handed to you for testing, it is non-refundable, because the work is done.

If you cancel before we start building, your deposit is refunded in full. If you cancel while work is in progress, we refund the part of the deposit covering work not yet done.

The monthly fee

Cancel any time. We refund pro-rata for full months paid but not used. The month in progress is not refunded. Your product stays online until the end of the paid period.

If we fail to deliver

If we cannot deliver a working product that does what we agreed, you get a full refund, deposit included. We would rather return your money than leave you with something that doesn't work.

Email support@noshdev.tech or WhatsApp +27 69 167 7662. We reply within 2 business days, and approved refunds are paid back to the original payment method within 10 business days.

Your rights

This policy does not limit your rights under the South African Consumer Protection Act, 2008.

Who is responsible

NOSH DEV (Pty) Ltd (registration 2026/715327/07) is the responsible party for personal information collected through this website and in providing our services. Reach us at support@noshdev.tech.

What we collect

• When you contact us: your name, phone number, email address, and what you tell us about your business.
• When you become a client: billing details, company registration details where relevant, and the content and branding you give us.
• Automatically: basic technical information such as IP address and browser type, used to keep the site working and secure.

Why we collect it

• To answer your enquiry and quote for work.
• To build, deliver, host and support your product.
• To invoice you and keep accounting records the law requires.
• To communicate with you about your project.

Who we share it with

We do not sell personal information. We share it only where needed with providers who help us operate — hosting, payment processing, messaging providers, and the Apple and Google app stores when publishing your product. Each is bound to protect what they handle.

Products we build for you

Where a product we build collects personal information from your customers, you are the responsible party for that information. We process it only on your instructions, and will sign an operator agreement with you where POPIA requires one.

How long we keep it

Enquiries that don't become projects are deleted after 12 months. Client records are kept 5 years after our relationship ends, as South African tax and company law require. Project files and source code are kept 12 months after cancellation, then deleted.

How we protect it

Information is held on access-controlled servers, encrypted in transit and at rest. Access is limited to people who need it. If a breach occurs that poses a risk to you, we will notify you and the Information Regulator as POPIA requires.

Your rights

You may ask what personal information we hold about you, ask us to correct or delete it, object to how we use it, or complain to the Information Regulator of South Africa. Email support@noshdev.tech and we respond within 30 days.
